These terms of use govern your use of www.genesishometutors.com, including our web app. Kindly ensure to read these terms before using our platform. By using our platform, you acknowledge that you totally understand, agree to and accept these terms and conditions and are bound by same.

Accounts

You may need an account for most activities on our platform. Keep your password somewhere safe because you are responsible for all activities associated with your account.

Content Enrolment and Access

When you enroll for a course, you get a license from us to view it via Genesis Home Tutors services and no other use. Course content on our website should not be transferred or resold in any way. A one year access is granted for any course enrolled, except when we must disable or take down the content for legal or policy reasons, or for enrollments via a subscription plan.

In more complete terms, Genesis Home Tutors grants you (as a learner), a non-exclusive, non-transferrable license to view the content which you have paid for solely for your personal, non- commercial, educational purposes. You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, edit or sublicense unless we give you the explicit permission to do so in a written agreement signed by an authorized representative of Genesis Home Tutors.

Services

Our platform provides tutoring services for those in need of private tutors, as well as provides online learning content should the learner decide not to use the services of a physical tutor. Genesis

Home Tutors has the right to suggest a befitting tutor to clients, but clients reserve the exclusive responsibility to select the right tutor for their needs.

In selecting a tutor, clients are also encouraged to review, investigate tutors, credentials, education, experience and reviews from past clients. Clients are to ensure that all tutoring sessions should be supervised by a responsible adult.

Conduct and Obligations

In consideration for the use of the platform, you agree:

That you are of legal age and have the capacity to agree to these terms or that you continue to use or access this platform under the supervision of someone who has the capacity to agree to these terms.
That Genesis Home Tutors cannot validate the age of every individual that accesses the platform, and thus may not be able to tell where a user is under the age of 13.
To maintain the security of your password and identification.
To provide accurate, current and complete information when prompted to by a registration form on the platform.
To give Genesis Home Tutors a period of 3 months from the date it issues a notice of data breach or potential data breach.
To use the platform in a manner that is lawful, relevant and proper to the already existing forums on the webapp. Any use deemed inappropriate and /or offensive may result in suspension and /or termination of a user with or without notice. Such inappropriate conducts include; defamation, abuse, harassment, harm, stalk, threats or other examples of violation of the rights of others, as well as using the platform for any purpose that is in violation of local, state, national or international laws, or attempting to gain unauthorized access to the platform and the accounts of other users.

Eligibility Conditions.

By using the platform, you represent that you currently meet and will continue to meet the following Eligibility Conditions for as long as you continue to use the platform:

That you have the right to enter into these terms and abide by these terms of use, and where you act on behalf of a minor, that you do so in good faith, and have been authorized to do so;
That you have and will at all times comply with all laws and regulations.
That neither you nor anyone in your home:
- has been the subject of a complaint, restraining order, or any legal action involving violence, abuse, neglect, or any offense that involves endangering the safety of others.
- has been and /or is currently required to register as a sex offender.
- Has been convicted of any crime including felony, child abuse, domestic and sexual abuse.

If there has been any accusation or complaint, whether or not it proceeded to trial, kindly inform Genesis Home Tutors before proceeding to use our request/registration services.

You hereby authorize Genesis Home Tutors to verify the above representation by you, and agree that Genesis Home Tutors has the right to verify such representations. You consent to any collection, use or disclosure information in order to accomplish such verification.

You also understand and agree that Genesis Home Tutors neither confirms nor denies the validity of information provided by users, and that Genesis Home Tutors does not verify that any or all of the Eligibility Conditions are met by users.

You understand and agree to make your own decisions and assessments about persons to engage either as a tutor or as a learner, and that it is your sole responsibility to conduct any and all background checks regarding other users.

Transactional Fees

You agree that you are willing to pay for all costs related with the services, whether for requesting a tutor or subscribing to our online content courses, and you authorize us to charge your debit or credit card or other means of payment for these fees. We reserve the right to disable access to content or offers for which we have not received adequate payment.

Disclaimers

It may happen that our platform is down either for planned maintenance or because something goes wrong with the site. It may happen that one of our instructors is making misleading statements in the content.

These are just examples. You accept that you have no recourse against us in any of these types of cases where things do not work out right. In legal, more complete language, the services and their content are provided on an ‘as is’ and ‘as available’ basis.

We make no representations or warranties about the suitability, reliability, availability, timeliness, security and accuracy of the services of our tutors and online course contents. Your use of the services is entirely at your own risk.

We are not responsible for delay or failure of our performance caused by events beyond our reasonable control like an act of war, hostility, sabotage, natural disaster, electrical, internet or telecommunication outage or government restrictions.

Indemnification

You agree to indemnify, defend, and hold harmless, Genesis Home Tutors and its subsidiaries, shareholders, offices, directors, licensors, employees and representatives from and against any and all claims, demands, causes of actions, losses, expenses, damages and /or liability incurred by Genesis Home Tutors in any way related to your:

Acts/omissions on or off the platform.
Violation of any rights or other users including alleged infringement of intellectual property or other right of any person or entity relating to the platform.
Breach of these terms and use.
Disputes with or between users.
Violation of any applicable laws or reputation.
Inaccurate, untimely, incomplete or misleading user information with respect to registration, profile or eligibility.

Updating These Terms.

From time to time, we may update these terms to clarify our practices or to reflect new or different practices (such as when we add new features) and Genesis Home Tutors reserves the sole right to modify and/or make changes to these terms at any time.

If there are any material changes, we will notify you by an email notice sent to the email address specified in your account. Your continued use of our services after changes become effective shall mean that you accept those changes.

Any revised term shall supersede previous terms.
